Terms of Service

1. Agreement to Terms

By accessing or using the web application "AWAI" (the "Service"), you agree to be bound by these Terms of Service.

2. Description of Service

The Service is a web application that analyzes conversations in meetings, opinions collected from participants, dialogues with AI, and pasted conversation text, then organizes and visualizes them by topic. Text entered by users and audio from meetings are processed by AI (Google Gemini API), and analysis results are stored on our servers.

3. Account and Authentication

Use of the Service requires an account. You can register and sign in with a Google account, a Microsoft account, or an email address and password. Users are responsible for maintaining the security of their account information.

4. Minors and Parental Responsibility

  • Independent use of the Service by children under the age of 13 is not permitted.
  • Minors aged 13 to 17 may use the Service only with parental consent and direct supervision.
  • The "Guest Mode" feature (compatibility diagnosis between yourself and a guest within the same account) is intended for a parent to supervise a minor on the same device while inviting them to use the Service. Any conversations and diagnosis results entered as the guest are linked to the parent (host) account, and the right to delete that data remains with the parent.
  • Parents must explain the contents of these Terms and the Privacy Policy to the minor in a form they can understand and obtain their consent before use.
  • We operate the Service on the assumption that any use by a minor is consented to by the parent under these Terms.
  • If you discover use by a minor that the parent did not consent to, please contact us. After verifying your identity, we will promptly delete the relevant data.

5. Plans and Quotas

  • Free: No charge. Usable within the points granted as a registration benefit
  • Plus / Pro / Ultra: Monthly subscription. Each plan grants a different number of points per month

The registration benefit (points and a free diagnosis ticket) is granted at the time of registration when you sign up with a Google account or a Microsoft account. If you sign up with an email address and password, you can receive it once you link a Google account or a Microsoft account.

The benefit is granted once per person. Those who have registered with us before are not eligible. However, if a year or more has passed since your previous account deletion, you become eligible again.

We also offer additional point purchases and one-time products (the AI personality test, the AI compatibility test, and group analysis). The pricing, point grants, and limits shown on the pricing page or on each purchase screen within the Service are the current terms for every plan and product. The expiry and other handling of points are set out in the Points Terms.

6. Prohibited Activities

The following activities are prohibited:

  • Reverse engineering, decompilation, or disassembly
  • Reselling, redistribution, or sublicensing of the Service
  • Unauthorized access or placing excessive load on the Service
  • Use for illegal, fraudulent, or malicious purposes
  • Unauthorized access to other users' accounts

In case of violation, we may suspend or delete your account without notice.

7. Intellectual Property and User Data

Ownership of the Service belongs to us. However, rights to the conversation text entered by users and the substantive content of analysis results belong to the users. We process user data only to the extent necessary for providing and improving the Service.

8. Payment and Refunds

Order processing is handled by Stripe, Inc. (payment processor). Refunds are processed in accordance with our Refund Policy.

9. Changes and Interruptions to the Service

We may change, add, or remove features of the Service without prior notice. We are not liable for temporary interruptions due to maintenance or other reasons.

10. Disclaimer

The Service is provided "as is" without warranties of any kind, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy or completeness of AI analysis results. Transcription and interpretation in the meeting feature are generated automatically, and we do not guarantee their accuracy or completeness either.

11. Limitation of Liability

We shall not be liable for any indirect, special, incidental, consequential, or punitive damages arising from use or inability to use the Service. Our total liability shall not exceed the amount paid by the user in the preceding 12 months.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Shizuoka District Court as the court of first instance.

13. Changes to These Terms

We may change these Terms in either of the following cases:

  • Where the change is in the general interest of users
  • Where the change does not conflict with the purpose of the contract and is reasonable in light of the necessity for the change, the appropriateness of the changed content, and other circumstances relating to the change

When we make a change, we will post the changed content and its effective date on the Service at least 30 days before that date. For minor changes such as correcting typographical errors or renumbering sections, we may post at least 7 days in advance.

For changes that materially affect your rights or obligations, we will also notify you at your registered email address in addition to the posting above.

If you do not agree to a change, you may cancel your subscription or delete your account before the effective date. The handling of points in that case is set out in the Points Terms.
